Robin George Colling Wood was a Fellow and Tutor in Philosophy at Pembroke College, Oxford, from 1912 to 1935. During this period he published or prepared his most important philosophical and historical works.

Do cultural models facilitate particular ways of perceiving interactions in nature? We explore variability in folkecological principles of reasoning about interspecies interactions. In two studies, Indigenous Panamanian Ngöbe and U.S. participants interpreted an illustrated, wordless nonfiction book about the hunting relationship between a coyote and badger. Across both studies, the majority of Ngöbe interpreted the hunting relationship as cooperative and the majority of U.S. participants as competitive. Study 2 showed that this pattern may reflect different beliefs about, and perhaps different (...) awareness of, plausible interspecies interactions. Further probes suggest that these models of ecological interaction correlate with recognition of social agency in nonhuman animals. We interpret our results in terms of cultural models of nature and nonhuman agency. (shrink)

Jakob Friedrich Fries is one of the most important representatives of the Critical Philosophy, someone who built immediately on the original Kantian philosophy. -/- Fries was born in 1773 in Barby (on the Elbe). In 1805 he was extraordinary professor for philosophy in Jena and in the same year was ordinary professor for philosophy in Heidelberg. Returning to Jena in 1816, one year later he was compulsorily retired because of his participation at the nationalistic and republican Wartburg Festival. In 1924 (...) he obtained a professorship for physics and mathematics, and in 1838 he was given back a professorship for philosophy. He died in 1843 in Jena. -/- The book summarizes the research results of the DFG-Project "Jakob Friedrich Fries' Influence on the Sciences of the 19th Century". The research project was carried out by Dr. Kay Herrmann (Institute of Philosophy, Jena University) and Prof. Dr. Wolfram Hogrebe (Institute of Philosophy, Bonn University). Such a study has special importance. There is available a large amount of literature about the "speculative contemporaries" of Fries, like Fichte, Schelling, and Hegel. In contrast to the "speculative philosophy", there has been published only a few studies about the Friesian natural philosophy. Fries was, in his natural-philosophical studies, looking for a link between philosophy and modern sciences, wheras his "speculative philosophical" contemporaries felt obligated to stick primarily to a descriptive, phenomenal view of nature. So far the question "How was mathematical natural philosophy regarded by scientists and mathematicians of the 19th century?" has hardly been investigated. Archival studies showed that this gap in Fries-research can be filled. The Friesian correspondence turned out to be a rich gold mine. -/- The present publication is more than a research report. The monographic first part is intended to introduce the foundations of the Friesian theory of cognition, the Friesian methodology, and the Friesian natural philosophy. This should facilitate entry into Friesian philosophy. -/- The Friesian theory is analyzed from two points of view: •How did Fries suceed in continuing and improving the Kantian approach? Is Fries able to remove the weak points of Kantian philosophy? -/- •What is the current significance of the Friesian approach? There are some interesting similarities between the Friesian approach and modern philosophical theories (such like Chomsky's theory of "universal grammer"). The lasting core of the Friesian theory of cognition is: To use empirical studies for working on philosophical problems. -/- Chapters 3 and 4 are scientific-historically oriented. These chapters analyze the Friesian position in scientific and mathematical debates (debates about the a priori foundations of physics, the problem of the identification of physics as an independent discipline, the problem of the boundary between chemistry and physics, the problem of mathematization of the sciences, the theory of the imponderabilia, the systematics and structure of sciences and mathematics, problems of infinity, the differential calculus, the theory of parallel lines) and the relation between Fries and the scientists of the 19th century. The book contains the latest findings gained by evaluation of the Friesian unpublished work (for example the correspondence with W. Weber, C. F. Gauß, E. F. Apelt, O. Schlömilch, Ch. Reichel, B. A. v. Lindenau, L. Gmelin, E. G. Fischer, A. N. Scherer, J. S. C. Schweigger) -/- One result of the research project is that some important scientists took a favourable view of the Friesian theory, but the influence of the Friesian philosophy on the sciences of the 19th century was very limited. The causes are very complex: An anti-natural-philosophical spirit of age, the limits of the Kantian inspired philosophy and some unfavourable aspects in the biography of Fries. -/- For the first time the voluminous Fries-Reichel-correspondence was evaluated. Ludwig Wittgenstein was a brilliant, intense, complex man, and this novel, a work of historical fiction but based on fact, explores his early thinking, which led him to publish one of the most important works of logic ever written. The story is told by David Pinsent, a student in mathematics who meets Wittgenstein at Trinity College in Cambridge, England, just before World War I. Despite Wittgenstein’s odd mannerisms and difficult personality, David is attracted to him, recognizing his genius immediately and (...) forming a friendship that is as volatile as it is rewarding. Wittgenstein, under the tutelage of the eminent mathematician and philosopher Bernard Russell, has developed a picture theory of meaning to explain human language through the lens of logic, and he is tormented by the idea that he will die before he is able to put it into book form and present it to the world. -/- Both David and Ludwig are welcomed into the elite intellectual circles at Cambridge, which consist of some of the most notable philosophers, mathematicians, and logicians of the day, including not just Russell but also men like John Maynard Keynes and G.E. In this “global information age” accessing, disseminating, and controlling information is an increasingly important aspect of human life. Often these interests are expressed in the language of human rights—e.g., rights to expression, privacy, and intellectual property. As the discipline concerned with, “Facilitating the effective communication of desired information between human generator and human user” (Belkin, 1975, 22), Library and Information Science (LIS) has a central role in facilitating communication about human rights and ensuring the respect for human rights in information (...) services and systems. This paper surveys the literature at the intersection of LIS and human rights. To begin, an overview of human rights conventions and an introduction to human rights theory is provided. Then the intersections between LIS and human rights are considered. Three central areas of informational human rights—communication, privacy, and intellectual property—are discussed in detail. It is argued that communication rights in particular serve as a central linchpin in the system of human rights. (shrink)

Jakob Friedrich Fries (1773-1843): A Philosophy of the Exact Sciences -/- Shortened version of the article of the same name in: Tabula Rasa. Jenenser magazine for critical thinking. 6th of November 1994 edition -/- 1. Biography -/- Jakob Friedrich Fries was born on the 23rd of August, 1773 in Barby on the Elbe. Because Fries' father had little time, on account of his journeying, he gave up both his sons, of whom Jakob Friedrich was the elder, to the Herrnhut Teaching (...) Institution in Niesky in 1778. Fries attended the theological seminar in Niesky in autumn 1792, which lasted for three years. There he (secretly) began to study Kant. The reading of Kant's works led Fries, for the first time, to a deep philosophical satisfaction. His enthusiasm for Kant is to be understood against the background that a considerable measure of Kant's philosophy is based on a firm foundation of what happens in an analogous and similar manner in mathematics. -/- During this period he also read Heinrich Jacobi's novels, as well as works of the awakening classic German literature; in particular Friedrich Schiller's works. In 1795, Fries arrived at Leipzig University to study law. During his time in Leipzig he became acquainted with Fichte's philosophy. In autumn of the same year he moved to Jena to hear Fichte at first hand, but was soon disappointed. -/- During his first sojourn in Jenaer (1796), Fries got to know the chemist A. N. Scherer who was very influenced by the work of the chemist A. L. Lavoisier. Fries discovered, at Scherer's suggestion, the law of stoichiometric composition. Because he felt that his work still need some time before completion, he withdrew as a private tutor to Zofingen (in Switzerland). There Fries worked on his main critical work, and studied Newton's "Philosophiae naturalis principia mathematica". He remained a lifelong admirer of Newton, whom he praised as a perfectionist of astronomy. Fries saw the final aim of his mathematical natural philosophy in the union of Newton's Principia with Kant's philosophy. -/- With the aim of qualifying as a lecturer, he returned to Jena in 1800. Now Fries was known from his independent writings, such as "Reinhold, Fichte and Schelling" (1st edition in 1803), and "Systems of Philosophy as an Evident Science" (1804). The relationship between G. W. F. Hegel and Fries did not develop favourably. Hegel speaks of "the leader of the superficial army", and at other places he expresses: "he is an extremely narrow-minded bragger". On the other hand, Fries also has an unfavourable take on Hegel. He writes of the "Redundancy of the Hegelistic dialectic" (1828). In his History of Philosophy (1837/40) he writes of Hegel, amongst other things: "Your way of philosophising seems just to give expression to nonsense in the shortest possible way". In this work, Fries appears to argue with Hegel in an objective manner, and expresses a positive attitude to his work. -/- In 1805, Fries was appointed professor for philosophy in Heidelberg. In his time spent in Heidelberg, he married Caroline Erdmann. He also sealed his friendships with W. M. L. de Wette and F. H. Jacobi. Jacobi was amongst the contemporaries who most impressed Fries during this period. In Heidelberg, Fries wrote, amongst other things, his three-volume main work New Critique of Reason (1807). -/- In 1816 Fries returned to Jena. When in 1817 the Wartburg festival took place, Fries was among the guests, and made a small speech. 1819 was the so-called "Great Year" for Fries: His wife Caroline died, and Karl Sand, a member of a student fraternity, and one of Fries' former students stabbed the author August von Kotzebue to death. Fries was punished with a philosophy teaching ban but still received a professorship for physics and mathematics. Only after a period of years, and under restrictions, he was again allowed to read philosophy. From now on, Fries was excluded from political influence. The rest of his life he devoted himself once again to philosophical and natural studies. During this period, he wrote "Mathematical Natural Philosophy" (1822) and the "History of Philosophy" (1837/40). -/- Fries suffered from a stroke on New Year's Day 1843, and a second stroke, on the 10th of August 1843 ended his life. -/- 2. Fries' Work Fries left an extensive body of work. A look at the subject areas he worked on makes us aware of the universality of his thinking. Amongst these subjects are: Psychic anthropology, psychology, pure philosophy, logic, metaphysics, ethics, politics, religious philosophy, aesthetics, natural philosophy, mathematics, physics and medical subjects, to which, e.g., the text "Regarding the optical centre in the eye together with general remarks about the theory of seeing" (1839) bear witness. With popular philosophical writings like the novel "Julius and Evagoras" (1822), or the arabesque "Longing, and a Trip to the Middle of Nowhere" (1820), he tried to make his philosophy accessible to a broader public. Anthropological considerations are shown in the methodical basis of his philosophy, and to this end, he provides the following didactic instruction for the study of his work: "If somebody wishes to study philosophy on the basis of this guide, I would recommend that after studying natural philosophy, a strict study of logic should follow in order to peruse metaphysics and its applied teachings more rapidly, followed by a strict study of criticism, followed once again by a return to an even closer study of metaphysics and its applied teachings." -/- 3. Continuation of Fries' work through the Friesian School -/- Fries' ideas found general acceptance amongst scientists and mathematicians. A large part of the followers of the "Fries School of Thought" had a scientific or mathematical background. Amongst them were biologist Matthias Jakob Schleiden, mathematics and science specialist philosopher Ernst Friedrich Apelt, the zoologist Oscar Schmidt, and the mathematician Oscar Xavier Schlömilch. Between the years 1847 and 1849, the treatises of the "Fries School of Thought", with which the publishers aimed to pursue philosophy according to the model of the natural sciences appeared. In the Kant-Fries philosophy, they saw the realisation of this ideal. The history of the "New Fries School of Thought" began in 1903. It was in this year that the philosopher Leonard Nelson gathered together a small discussion circle in Goettingen. Amongst the founding members of this circle were: A. Rüstow, C. Brinkmann and H. Goesch. In 1904 L. Nelson, A. Rüstow, H. Goesch and the student W. Mecklenburg travelled to Thuringia to find the missing Fries writings. In the same year, G. Hessenberg, K. Kaiser and Nelson published the first pamphlet from their first volume of the "Treatises of the Fries School of Thought, New Edition". -/- The school set out with the aim of searching for the missing Fries' texts, and re-publishing them with a view to re-opening discussion of Fries' brand of philosophy. The members of the circle met regularly for discussions. Additionally, larger conferences took place, mostly during the holidays. Featuring as speakers were: Otto Apelt, Otto Berg, Paul Bernays, G. Fraenkel, K. Grelling, G. Hessenberg, A. Kronfeld, O. Meyerhof, L. Nelson and R. Otto. On the 1st of March 1913, the Jakob-Friedrich-Fries society was founded. Whilst the Fries' school of thought dealt in continuum with the advancement of the Kant-Fries philosophy, the members of the Jakob-Friedrich-Fries society's main task was the dissemination of the Fries' school publications. In May/June, 1914, the organisations took part in their last common conference before the gulf created by the outbreak of the First World War. Several members died during the war. Others returned disabled. The next conference took place in 1919. A second conference followed in 1921. Nevertheless, such intensive work as had been undertaken between 1903 and 1914 was no longer possible. -/- Leonard Nelson died in October 1927. In the 1930's, the 6th and final volume of "Treatises of the Fries School of Thought, New Edition" was published. Franz Oppenheimer, Otto Meyerhof, Minna Specht and Grete Hermann were involved in their publication. -/- 4. About Mathematical Natural Philosophy -/- In 1822, Fries' "Mathematical Natural Philosophy" appeared. Fries rejects the speculative natural philosophy of his time - above all Schelling's natural philosophy. A natural study, founded on speculative philosophy, ceases with its collection, arrangement and order of well-known facts. Only a mathematical natural philosophy can deliver the necessary explanatory reasoning. The basic dictum of his mathematical natural philosophy is: "All natural theories must be definable using purely mathematically determinable reasons of explanation." Fries is of the opinion that science can attain completeness only by the subordination of the empirical facts to the metaphysical categories and mathematical laws. -/- The crux of Fries' natural philosophy is the thought that mathematics must be made fertile for use by the natural sciences. However, pure mathematics displays solely empty abstraction. To be able to apply them to the sensory world, an intermediatory connection is required. Mathematics must be connected to metaphysics. The pure mechanics, consisting of three parts are these: a) A study of geometrical movement, which considers solely the direction of the movement, b) A study of kinematics, which considers velocity in Addition, c) A study of dynamic movement, which also incorporates mass and power, as well as direction and velocity. -/- Of great interest is Fries' natural philosophy in view of its methodology, particularly with regard to the doctrine "leading maxims". Fries calls these "leading maxims" "heuristic", "because they are principal rules for scientific invention". -/- Fries' philosophy found great recognition with Carl Friedrich Gauss, amongst others. Fries asked for Gauss's opinion on his work "An Attempt at a Criticism based on the Principles of the Probability Calculus" (1842). Gauss also provided his opinions on "Mathematical Natural Philosophy" (1822) and on Fries' "History of Philosophy". Gauss acknowledged Fries' philosophy and wrote in a letter to Fries: "I have always had a great predilection for philosophical speculation, and now I am all the more happy to have a reliable teacher in you in the study of the destinies of science, from the most ancient up to the latest times, as I have not always found the desired satisfaction in my own reading of the writings of some of the philosophers. In particular, the writings of several famous (maybe better, so-called famous) philosophers who have appeared since Kant have reminded me of the sieve of a goat-milker, or to use a modern image instead of an old-fashioned one, of Münchhausen's plait, with which he pulled himself from out of the water. These amateurs would not dare make such a confession before their Masters; it would not happen were they were to consider the case upon its merits. I have often regretted not living in your locality, so as to be able to glean much pleasurable entertainment from philosophical verbal discourse." -/- The starting point of the new adoption of Fries was Nelson's article "The critical method and the relation of psychology to philosophy" (1904). Nelson dedicates special attention to Fries' re-interpretation of Kant's deduction concept. Fries awards Kant's criticism the rationale of anthropological idiom, in that he is guided by the idea that one can examine in a psychological way which knowledge we have "a priori", and how this is created, so that we can therefore recognise our own knowledge "a priori" in an empirical way. Fries understands deduction to mean an "awareness residing darkly in us is, and only open to basic metaphysical principles through conscious reflection.". -/- Nelson has pointed to an analogy between Fries' deduction and modern metamathematics. In the same manner, as with the anthropological deduction of the content of the critical investigation into the metaphysical object show, the content of mathematics become, in David Hilbert's view, the object of metamathematics. -/-. Nelson's Proof of the Impossibility of the Theory of Knowledge -/- In addressing the possibility of a theory of knowledge, Leonard Nelson noted the contradiction of an epistemological criterion that one would require in order to differentiate between valid and invalid knowledge. Nelson concluded that the inconsistency of such a criterion proves the impossibility of the theory of knowledge. -/- Had the epistemological criterion had a perception, then it would presume to adjudicate on its own truth (thus epistemological circular argument). (...) However, if one were to assume that the criterion is not knowledge, one would then have to justify how this is a criterion for truth - yet this would only be possible when it may be considered as an object of knowledge. One would equally have had to predetermine the criterion in order to determine the truth of this knowledge, thereby providing another circular argument. Ostensibly, every criterion of truth fails at its very own test since it cannot guarantee its own truth, just as Munchausen, contrary to his assertion, could not draw himself out of the swamp by tugging on a tuft of his own hair. -/- Nelson proposed a solution of the epistemological problem (the question of the differentiation between valid and invalid knowledge), that based on Jakob Friedrich Fries' differentiation between proof and deduction. Proof, according to Nelson (in reference to Fries), can be defined as derivation of truth from one statement from another statement. Thus, from the truth in the statement that "all men are mortal", one is then able to say that "Socrates is a man" and thence extrapolate from the truth of the statement that "Socrates is mortal." If knowledge were to be considered somewhat judgmental (in a statement), then an attempt at proof (i.e. recourse to previous judgments) would inevitably lead to an infinite regression in justification, since each judgment would necessitate a further justification from another judgment. Every attempt to prove an epistemological criterion is thus also confronted by this regression in justification. -/- Nelson's attempt at a solution rests on the assumption of the existence of an immediate knowledge as a justification of the truth (mediate) of knowledge. Nelson considers immediate knowledge to be non-judgmental knowledge. These include intuitions (e. g. seeing-the-red-roof) and also philosophical knowledge that pre-exists in his opinion before a judgmental reflexion (immediate) in our reason (e. g. the principle of causality). -/- Proof of the truth of mediate knowledge can be effected by showing its compliance with attendant immediate knowledge (rational truth = correspondence of mediate knowledge with their immediate knowledge). Nelson considered this as a resolution of the circular epistemological argument. In regard to philosophical knowledge, Nelson sees these as subject to deduction and not proof. His Special Theory of Relativity (1905) allows "travel into the future" through the effect of time dilation he predicted, and Einstein's theory of gravity allows for closed time lines as solutions to its equations (e.g., Gödel cosmos, anti-de Sitter cosmos). However, traveling in a time loop would immediately lead to a number of paradoxes (e.g., grandfather paradox, information paradox). Although, surprisingly, the basic laws of physics (apart from extremely rare and macroscopically non-appearing quantum mechanical effects) would not be violated in a time reversal, there seems to be a fundamental prohibition of traveling into the past in nature. We give an examination of the automorphism group Aut of a countable recursively saturated model M of PA. The main result is a characterisation of strong elementary initial segments of M as the initial segments consisting of fixed points of automorphisms of M. As a corollary we prove that, for any consistent completion T of PA, there are recursively saturated countable models M1, M2 of T, such that Aut[ncong]Aut, as topological groups with a natural topology. Other results include a classification (...) of the normal subgroups of Aut of the form [lcub]g: g [uharr] A = idA[rcub], for sets A M, and a highly homogeneous representation of Aut as a subgroup of Aut. In this paper, we defend the general thesis that intentions are relevant not only to moral permissibility and impermissibility, but also to criminal wrongdoing, as well as a specific version of the Doctrine of Double Effect that we believe can help solve some challenging puzzles in the criminal law. We begin by answering some recent arguments that marginalize or eliminate the role of intentions as components of criminal wrongdoing [e.g., Alexander and Ferzan, Chiao, Walen ]. We then turn to some (...) influential theories that articulate a direct role for intentions [e.g., Duff, Husak ]. While we endorse the commitment to such a role for intentions, we believe that extant theories have not yet been able to adequately address certain objections or solve certain puzzles, such as that some attempt convictions require criminal intent when the crime attempted, if successful, requires only foresight, and that some intended harms appear to be no more serious than non-intended ones of the same magnitude, for example. Drawing on a variety of resources, including the specific version of the Doctrine of Double Effect we have developed in recent published work, we present solutions to these puzzles, which in turn provide mutual support for our general approach to the role of intentions and for thinking that using others as means is itself a special kind of wrongdoing. Psychologists and philosophers who pose moral dilemmas to understand moral judgment typically specify outcomes as certain to occur in them. This contrasts with real-life moral decision-making, which is almost always infused with probabilities (e.g., the probability of a given outcome if an action is or is not taken). Seven studies examine sensitivity to the size and location of shifts in probabilities of outcomes that would result from action in moral dilemmas. We find that moral judgments differ between actions that result (...) in an equal increase in probability of harm (equal size), but have different end-states (e.g., an increase in harm probability from 25% to 50% or from 50% to 75%). This deviation from expected value is robust under separate evaluation, and increases when the comparison between shifts is made explicit under simultaneous evaluation. Consistent with the centrality of perceived harm in some models of moral judgment, perceived harm partially mediates sensitivity to location of harm probability shift. Unlike for shifts in harm probabilities, participants are insensitive to the location of shifts in probability of beneficial outcomes. They are also insensitive to the location of shifts in probability of analogous monetary losses and gains, suggesting an asymmetry between harm and benefit in moral reasoning, as well as an asymmetry between moral and monetary decision-making more broadly. When forecasting events, multiple types of uncertainty are often inherently present in the modeling process. Various uncertainty typologies exist, and each type of uncertainty has different implications a scientist might want to convey. In this work, we focus on one type of distinction betweendirect quantitative uncertaintyandindirect qualitative uncertainty. Direct quantitative uncertainty describes uncertainty about facts, numbers, and hypotheses that can be communicated in absolute quantitative forms such as probability distributions or confidence intervals. Indirect qualitative uncertainty describes the quality of knowledge (...) concerning how effectively facts, numbers, or hypotheses represent reality, such as evidence confidence scales proposed by the Intergovernmental Panel on Climate Change. A large body of research demonstrates that both experts and novices have difficulty reasoning with quantitative uncertainty, and visualizations of uncertainty can help with such traditionally challenging concepts. However, the question of if, and how, people may reason with multiple types of uncertainty associated with a forecast remains largely unexplored. In this series of studies, we seek to understand if individuals can integrate indirect uncertainty about how “good” a model is (operationalized as a qualitative expression of forecaster confidence) with quantified uncertainty in a prediction (operationalized as a quantile dotplot visualization of a predicted distribution). Our first study results suggest that participants utilize both direct quantitative uncertainty and indirect qualitative uncertainty when conveyed as quantile dotplots and forecaster confidence. In manipulations where forecasters were less sure about their prediction, participants made more conservative judgments. In our second study, we varied the amount of quantified uncertainty (in the form of the SD of the visualized distributions) to examine how participants’ decisions changed under different combinations of quantified uncertainty (variance) and qualitative uncertainty (low, medium, and high forecaster confidence). The second study results suggest that participants updated their judgments in the direction predicted by both qualitative confidence information (e.g., becoming more conservative when the forecaster confidence is low) and quantitative uncertainty (e.g., becoming more conservative when the variance is increased). Based on the findings from both experiments, we recommend that forecasters present qualitative expressions of model confidence whenever possible alongside quantified uncertainty. (shrink)

“Dünyadaki kötülüklerin varlığı, geleneksel teizmdeki Tanrı inancı için bir problem oluşturur mu?” 2000 yıldan fazla zamandır çok çeşitli geleneklerden gelen düşünürleri meşgul eden bu çetrefilli soruya bu kitap, en güncel tartışmalardan hareketle cevap vermeye çalışıyor. Kötülük probleminin tarihsel gelişimini, mantıksal ve delilci kötülük argümanlarını özetledikten sonra kitap, geleneksel ve modern teist çözüm önerilerini ele alıyor: Özgür iradenin varlığı veya manevi gelişim potansiyeli, kötülüklerin varlığını meşru hâle getirir mi? Etrafımızda gördüğümüz kötülüklerin gerekçesi konusunda şüpheci tavır takınıp Tanrı'nın hikmetinin, insanın kısıtlı zihni (...) tarafından sorgulanamayacağı sonucuna mı varmalıyız? Özel olarak İslami gelenek içinde kötülük problemini çözmemizi sağlayacak kaynaklar bulabilir miyiz? Kitap, tüm bu önerilerin yetersiz kaldığını iddia ederken karşı cevap olarak modern "kötü tanrı" argümanını ele alıyor. Buna ek olarak ilahi adaleti tehdit eden ilahi gizlilik ve benzeri argümanlar, kötülük problemini daha da çözümsüz hâle getiriyor. Kötülük probleminin çözümsüzlüğü, evrenin bizim acılarımıza ve isyanımıza kayıtsız olduğu ihtimali ise bizi daha üst düzey bir probleme, anlam problemine taşıyor. İlimler, sanatlar ve mesleklerin mazisi tarihe konu olduğu gibi, tarih de farklı sahalara mensup kimseler tarafından kaleme alınmıştır. İslam toplumunda 3./9. yüzyıldan itibaren tıp ve tabipler tarihine dair eserler yazılmaya başlamıştır. Öte yandan, tabiplerin de çağının tanığı olarak tarih yazdıklarını görmekteyiz. İslam dünyasında tabiplerin tarih yazıcılığının ilk örneklerine Abbâsî Devleti’nde rastlamaktayız. Saray tabipleri halifelerin ve devlet ricalinin tedavisiyle vazifeli iken, aynı zamanda siyasi ve toplumsal hadiselere de bizzat yakından şahit olmuşlardır. Bu tabiplerden bazıları gördüklerini rivayet ederek tarih yazımına dolaylı yoldan (...) katkıda bulunmuş, bazıları ahbâr veya kronik türünden eser yazarak çağını kayıt altına almış, bazıları da hatırat kaleme alarak müşahedelerini gelecek nesillere aktarma yolunu seçmiştir. Bu araştırmada Abbâsî Devleti’nin ilk iki asrında sarayda tabip olarak hizmet etmenin yanı sıra tarih eseri yazan şahsiyetler tespit edilmeye çalışıldı. Bu tabiplerin dönemin tarih yazıcılığına ne tür katkı sağladıkları, kaleme aldıkları tarih eserlerindeki hususiyetler ve Abbâsî sarayında istihdam edilen tabiplerin gündelik yaşamlarının öne çıkan yönleri ele alındı. Özellikle Abbâsî sarayı tabiplerinden Huneyn b. İshak’ın tarihe kaynaklık eden hatıratı ve Sâbit b. Sinân’ın kroniği üzerinde duruldu. (shrink)

Kitaplar, bir fikrin ve düşüncenin veya zihniyetin taşıyıcıları olduğu kadar, üretildikleri bağlama dair de bilgiler sunan kalıntılardır. Bir eserin yazma versiyonları söz konusu olduğunda, her bir nüshanın ayrı bir özgünlük değeri bulunmaktadır. Yazıma konu olan metin belki ortaktır ama yazma nüshalar; çoğaltan kişi, çoğaltılan yer ve zaman, çoğaltmada kullanılan yazı şekli, kâğıt türü gibi unsurlar bakımından kendilerine özgü nitelikler taşımaktadır. Eserin yazıldığı bağlam hakkında ilk elden bilgilerin sunulduğu bu kısımlara yansıyan içerik, bazen eserin tüm muhtevasından bile daha önemli olabilmektedir. Bu (...) yüzden de bazen her biri ayrı bir tarih vesikasına dönüşebilmektedir. ʿAlī b. Ötemiş b. Süleymān isimli fakat ʿAlā-i Aḫlāṭī olarak maruf bir Hanefî âlim tarafından istinsah edilen mecmūʿa bu bakımdan oldukça dikkat çekicidir. Mecmūʿa içerisinde Hanefî geleneğe dair çeşitli eserler yer almaktadır; ancak bunlardan daha önemli olan bu eserlerin nasıl ve nerede istinsah edildiğine dair müstensihin ferağ kayıtlarında verdiği bilgilerdir. Bu bilgilere bakıldığında, müstensihin muhtemelen Buhara kökenli olduğu ve Anadolu’ya gelip Ahlat’ı vatan edindiği görülmektedir. Artık Anadolu’da yaşamasına karşın, bir sebeple büyük Moğol istilasına maruz kalmasından on bir yıl önce Buhara’ya tekrar gitmiş, buradaki ilim meclislerinde bulunmuş ve önemsediği bazı eserleri istinsah edip yanında Ahlat’a getirmiştir. Bu mecmūʿa ise zamanla Kastamonu’ya kadar gelmiştir. Bu yazıda, söz konusu mecmūʿa nın ferağ kayıtlarında geçen bilgilerden hareketle ʿAlā-i Aḫlāṭī’nin hayat hikayesi ortaya çıkarılmaya çalışılmıştır. (shrink)

İslam’ın toplum hayatındaki tezahürlerinin mahiyet ve işlevi hakkındaki tartışmalar neredeyse Hz. Peygamber’in vefatından hemen sonraya kadar uzanır. Kelamın ehl-i hadisi eleştirisinde, Müslüman filozofların kelamcıları eleştirisinde, Gazzâlî’nin (ö. 1111) filozofları eleştirisinde daima İslam’ın “nasıl” anlaşılması gerektiği sorusunu görmek mümkündür. Gazzâlî ve İbn Rüşd (ö. 1198) gibi birbirine muhalif olan iki âlimin dahi kendi dönemlerindeki fukahayı eleştirmede müttefik olmasında yine İslam’ın “nasıl” anlaşılması gerektiği ve toplum hayatında “nasıl” uygulanacağı sorusu görülebilir. Son yüz yıllık dönemde ise bu tartışmalar ve uğraşların zirve yaptığını söyleyebiliriz. (...) Müslümanlar olarak küçük bir köye dönüşen dünyaya kayıtsız kalamayız, kendimizi merkeze aldığımız bir dünya tasavvur edemeyiz. Sosyolojimizin, psikolojimizin, siyaset, ekonomi, eğitim ve kültürümüzün diğer milletler ve din mensupları ile etkileşim halinde olduğu gerçeğini yok sayamayız. Durum böyle olunca maalesef Müslüman ülkelerin birçok alanda yaşamış olduğu sorunlar her geçen gün yüzümüze vurulmaktadır. Konuya vakıa tespiti yaparak başladığımız takdirde incelemesini yapacağımız İslam Işığında Müslümanlığımızla Yüzleşme eserinin önemi daha belirgin olacaktır. (shrink)

Bu çalışmada Kazvinî (ö. 1283)’nin kozmografya ve coğrafya konularında kaleme aldığı eseri Acâibü'l-Mahlûkât ve Ğarâibü'l-Mevcûdât’ın yurtiçi ve yurtdışındaki çeşitli kütüphanelerde yer alan, farklı dönemlere ait bazı Arapça, Farsça ve Türkçe nüshalarındaki Segsar Adası’nda yaşayan iki kavmin tasvirleri incelenmektedir. Zenc Denizi’nde bulunan Segsar Adası’ndaki köpek başlı insan ve kayış ayaklı insan şeklinde bildirilmiş iki farklı kavme dair hikayeler eserin Süfliyyât konulu ikinci makalesinde zikredilmektedir. Segsar Adası’nın bahsi geçen sakinleri hakkındaki malumata ve ilgili tasvirlere eserin pek çok nüshasında Bahr-i Zenc başlığı altındaki (...) Cezire-i Segsar bölümünde rastlanmaktadır. Eserde ayrıca ikinci makalenin Bahr-i Hind başlığı altındaki Cezire-i Kasr bölümünde Zülkarneyn’in askerleriyle birlikte uğradığı Billur Köşk’te yaşayan köpek başlı bir kavimden bahsedilmektedir. Ahmedî (ö. 1412-13)’nin İskendernâme isimli eserindeki Zülkarneyn’in Etvar Adası ve bir başka adadaki Billur Köşk ziyaretleriyle ilgili bölümlerde de rastlanan bu rivayetle ilgili tasvirler de mukayese amacıyla çalışmaya dahil edilmiştir. Benzer şekilde İskendernâme’de aktarılan Zülkarneyn’in Mazenderan seferinde karşılaştığı kement ayaklı devle ilgili rivayetin de muhtemelen Acâibü'l-Mahlûkât’taki kayış ayaklı kavme dair hikâyenin etkisiyle oluşturulduğu düşünüldüğünden, bu konuya ilişkin tasvirler de çalışmada yer almaktadır. Bu makale kapsamında incelenmiş 13. yüzyıldan 19. yüzyıla kadar farklı dönemlere ait ve dönemlerinin minyatür geleneğini yansıtan tüm tasvir örnekleri benzer ve farklı yönleriyle değerlendirmeye tabi tutulmaktadır. Bu makalede, Abbâsî dönemi şairlerinden İbnu’r-Rûmî’nin Abbâsî hanedanlığının bir üyesi olan Abdülmelik b. Sâlih için nazmettiği methiyesinin tematik bir incelemesinin yapılması planlanmaktadır. Bu analiz, İbnu’r-Rûmî’nin methiyesinin karmaşık katmanlarına derinlemesine bir bakış sağlamaktadır. Methiye, bilhassa Abbâsî döneminin Arap edebî geleneğinde önemli bir yeri bulunan şiirsel bir ifade biçimidir. Yapılan çalışmanın konusu, methiyedeki tematik unsurların araştırılmasına ve İbnu’r-Rûmî’nin hem övgüsel hem de eleştirel anlayışa sahip bir anlatı oluşturmak için dili ve imgeleri nasıl kullandığının ortaya çıkartılmasına dayanmaktadır. Araştırmanın kapsamı, bahis mevzu methiyenin tarihî (...) ve kültürel arka planı bağlamında anlaşılmasının sağlanmasına kadar uzanmaktadır ve Abbâsî döneminin toplumsal normlarının, değerlerinin ve beklentilerinin anlaşılmasına da ehemmiyet vermektedir. Bu yaklaşım, metnin öneminin daha derinlemesine anlaşılmasını sağlamaktadır ve salt övgünün ötesine geçerek dönemin sosyopolitik dinamikleri hakkında bir yorum sunmaktadır. Öte yandan mevcut tarihî kayıtların İbnu’r-Rûmî ile Abdülmelik b. Ṣāliḥ arasındaki ilişki hakkında çok az ayrıntı sunduğunu ve mevcut belgelerde bu konuda kapsamlı bilgi bulunmadığını vurgulamak gerekir. Bu çalışmanın önemi, klasik Arap edebiyatı alanına yaptığı katkısından, özellikle de methiyelerin bu literatür geleneğindeki rolünün ve gelişiminin anlaşılması hususundaki önceliğinden kaynaklanmaktadır. İbnu’r-Rûmî’nin eserinin analizi vasıtasıyla bu araştırma, methiye nazmının karmaşık doğasına dikkat çekmesinin yanı sıra; şair, şiirde övülen kişi ve şaire verilen maddi ödül arasındaki ilişkinin ayrıntılı şekilde anlaşılmasını da sağlamaktadır. Araştırmada benimsenen yöntem, daha derinlemesine bir anlayış kazanmak maksadıyla, manzumenin temalarını parçalara ayırmaya odaklanan yakın bir metinsel analizi içermektedir. (shrink)

Çalışma Hıristiyanlığın Protestanlık mezhebinden doğan, özellikle Amerika Birleşik Devletleri’nde kümelendiği gözlemlenen, İsrail’i ve Yahudileri orantısızca desteklemesiyle bilinen ve aynı zamanda İslam’a ve Müslümanlara karşı düşmanca yaklaşımları haiz “Hıristiyan siyonistlerini” ele almaktadır. Hareketin mahiyeti, doğuşu, teolojisi, faaliyetleri ve kendisinde mündemiç olan antisemitizm ile anti-İslamizm olguları incelenmektedir. Bulgulara göre, Hıristiyan siyonizmi çeşitli açılardan bakıldığında bir anomali teşkil etmektedir. Bunlardan en önemlisi, Yahudilerin ve Hıristiyanların yüzyıllarca birbirlerine en üst seviyede düşmanlık etmiş olan iki topluluk oluşudur. Hıristiyan siyonistler dünya tarihini Mesih’in zuhuruyla birlikte kurulacak (...) olan bin yıllık küresel krallık öncesindeki yedi bölüm olarak ele alan, sınırları büyük ölçüde İngiliz-İrlandalı teolog John Nelson Darby tarafından çizilen ve “premillennial dispensationalism (premilenyal dispensasyonalizm)” olarak bilinen teolojinin öngördüğü kıyamet senaryosuna inanmaktadır. Bu senaryo hareketin varlık sebebini, amaçlarını, dostlarını ve düşmanlarını belirlemektedir. Dost-düşmanlar olarak Yahudilerin buradaki rolü bazı çelişkiler ve ihtilaflar barındırırken, düşmanlar olarak Müslümanların rolü açıkça olumsuz bir görünüm arz etmektedir. Bunun sonucu olarak Hıristiyan siyonistler Müslümanları şeytanlaştırma eğilimine girmektedir. Her ne kadar dindaşları tarafından ahlak, siyaset ve özellikle teoloji eksenlerinde ağır eleştirilere tabi tutulsalar da Hıristiyan siyonistler emperyalist güçlerle olan uzun ittifaklarının da bir meyvesi olarak dünya politikasında kayda değer bir güce sahiptir. Hıristiyan siyonizminin mahiyeti ve dahi antisemitizm ve anti-İslamizm ile irtibatı konusunda Türkçe yazılmış eserlerin azlığına binaen çalışma literatürdeki bu boşluğu kapatma amacı taşımaktadır. Özet: İçinde bulunduğumuz dönemde anti-İslamizm kavramı ele alınırken kendisine özellikle Amerika Birleşik Devletleri’nin (ABD) teopolitik dekorunda yer bulan “Hıristiyan siyonizmi” adlı grubun etkisine işaret edilmektedir. Bu grup literatür tarafından İsrail’i Yahudilerin vatanı olarak destekleyen Hıristiyanlar olarak tanımlanmaktadır. İsrail için Birleşen Hıristiyanlar (CUFI) gibi organizasyonlar aracılığıyla İsrail’in desteklenmesi noktasında etkin faaliyetler yürütmektedirler. Orta Doğu’da barışın tesis edilmesini inandıkları kıyamet senaryosunun önünde bir engel olarak gördükleri için kategorik olarak reddetmektedirler. Özellikle 19. yüzyılda başlayıp, 11 Eylül olayları ile birlikte ciddi bir ivme yakalayan ABD’deki anti-İslami hareketlerin büyük bir kısmı Hıristiyan siyonizmi ile ilişkilendirilen şahıslar tarafından başlatılıp desteklenmektedir. ABD’de yaklaşık 20 ila 30 milyon arasında Hıristiyan’ın bu ideolojiyi benimsediği tahmin edilmektedir. ABD dışında İngiltere, İskandinavya, Avustralya, Güney Afrika ve hatta Güney Kore ve Honduras gibi coğrafyalarda da taraftar bulmuşlardır. Birçok açıdan bakıldığında Hıristiyan siyonizmi bir anomali teşkil etmektedir. Bunun özünde Yahudilerin ve Hıristiyanların birbirlerine olan düşmanlıkları yatmaktadır. Yahudiler dini kaynaklarında Hıristiyanlığın en kutsal şahsiyetlerine ağır hakaretler ederken, Hıristiyanlar Yahudileri Tanrı katilleri olarak görmektedir. Ancak Hıristiyan siyonistlerin çoğunluğu İsrail konusunda adeta kraldan daha kralcı davranmaktadır. Hıristiyan siyonizminin teolojik zeminini incelemek isteyen bir araştırmacı eskatoloji (kıyamet bilimi), Armageddon savaşı, istiğrak, püritenler, premilenyalistler, dispensasyonalistler, fundamentalistler, restorasyonistler, evanjelistler, John Nelson Darby ve Cyrus I. Scofield gibi bazı kavram ve aktörlerle karşılaşacaktır. İrlandalı-İngiliz bir teolog olan Darby birçokları tarafından Hıristiyan siyonizminin kurucusu olarak görülmektedir. Hareket için hayati önem teşkil eden ikinci isim ise Cyrus Ingerson Scofield’dir. Scofield Reference Bible ’ı yayınlayarak Hıristiyan siyonizminin milyonlar tarafından benimsenmesine yol açmıştır. Hıristiyan siyonistler “premilenyal dispensasyonel teolojinin” gerçek olduğuna ve gerçekleşeceğine inanmaktadır. Buna göre dünya tarihi yedi çağdan oluşan doğrusal bir olgudur. İnsanlığın halihazırda altıncı çağda olduğuna, yedinci çağın ise çok yakında olduğuna inanmaktadırlar. Bu teolojinin öngördüğü kıyamet senaryosu Antichrist ’ın gelişi, Sahte Peygamber ve Şeytan ile birlikte cehennem teslisini kurması, Müslümanların da onlarla müttefik olarak hareket edip İsrail’e saldırmaları (Armageddon savaşı), Hz. İsa’nın gökten tekrar inerek İsrail’i kurtarması ve barışı tesis edeceği Milenyum Krallığı’nı kurması gibi öğeleri içermektedir. Siyonist olmayan Hıristiyan teologlar Hıristiyan siyonizminin teolojisini defaatle eleştiriye tabi tutmuştur. Yahudilerin seçilmiş ırk olarak görülmesi, Yeni Ahit’in bu ideolojiye destek vermemesi, “Armageddon savaşının” büyük mezheplerde karşılığının olmayışı ve hareketin Yahudi karakteri taşıması gibi sebepler yüzünden bazı Hıristiyan teologlar Hıristiyan siyonizmini heretik ilan etmiştir. Hıristiyan siyonizminin teolojisinin eleştirildiği bir diğer husus ise onun emperyal teoloji olarak yerine getirdiği işlev ile ilgilidir. Birçok düşünür Hıristiyan siyonizmi, Yahudi-Hıristiyan Batı anlatısı ve emperyalizm arasında sağlam bağlar olduğunu iddia etmektedir. Hıristiyan siyonizmi anomalisine bir açıklama getirmek isteyen şahıslar Hıristiyan siyonizmi içerisinde yer alan antisemitizme işaret etmektedir. Buna göre Hıristiyan siyonistler, Yahudilerin ve Yahudi devletinin kurulmasının gerçekleşmesinde hayati bir rol oynadığı kıyamet senaryolarını yürürlüğe koymak adına İsrail’i her şartta desteklerken, bu senaryo Yahudilerin kendisini Mesih gibi gösteren Antichrist tarafından yönetilmesini ve Yahudilerin çoğunluğunun Mesih’in gelişinden sonra ölmesini içermektedir. Aynı zamanda neredeyse daima İsrail yanlısı açıklamalar yapan bazı Hıristiyan siyonistlerin zaman zaman doğrudan antisemitik söylemlere başvurduğu gözlemlenebilmektedir. Bu sebeple Hıristiyan siyonistler ve Yahudiler arasındaki teopolitik ittifakın bir noktada bozulacak pragmatik bir ittifak olduğu iddia edilmektedir. Anti-İslamizm noktasındaki bulgulara göre Hıristiyan siyonistlerin %70’i Araplara karşı ya kayıtsız ya da düşmanca hisler beslemektedir. 11 Eylül’den sonraki dönemde İslam’ın şeytanlaştırılması operasyonu büyük ölçüde Robertson, Graham, Lindsey, Vines ve Falwell gibi Hıristiyan siyonistler tarafından gerçekleştirilmiştir. Yine İsrail’in 1948 yılında kuruluşu, Filistinliler için doğurduğu sonuçlara rağmen Hıristiyan siyonistlerin çoğu için bir kıyamet alametinin gerçekleşmesi anlamına gelmektedir. Hıristiyan siyonistlerin inandıkları kıyamet senaryosunda Müslümanlar ancak düşman saflarında savaşan Gog ve Magog olarak anlam bulabilmektedir. Onlar Şeytan, Antichrist ve Sahte Peygamber ’den oluşan cehennem teslisinin müttefikleridir. Filistinliler, Araplar ve Müslümanlar senaryonun gerçekleşmesi önünde doğrudan engel teşkil etmektedir. Bu hususlar birlikte değerlendirildiğinde halihazırda Hıristiyan siyonistlerin İslam’a ve Müslümanlara neden bu kadar olumsuz yaklaştıkları hususu açıklık kazanmaktadır. Görüldüğü üzere karşı karşıya olunan, gerçek dünyadaki gerçek olaylar ve aktörler hakkında rasyonalizasyona ve değişime kapalı olan, son derece tehlike arz eden dini inançlardır. Hıristiyan siyonizmi üç dinin etkileşime girdiği, üç dinin de bağlılarını ilgilendiren bir fenomendir. Teolojik analiz hareketin Hıristiyanlık dininin kutsal metinlerini İsrail lehine yorumladığını, ancak siyonist olmayan Hıristiyan teologlarca desteklenmediğini göstermektedir. Emperyalist ajandalar dahilinde ABD ve İngiltere gibi devletlerce de destek bulan bu hareketin kıyamet senaryosuna göre Müslümanlar Şeytan’ın müttefikleri olarak kötülüğün tarafındadır. Hz. İsa’nın yeryüzüne dönüşüyle yenilecekler ve yok edileceklerdir. Milyarlarca dolarlık bütçeleriyle, sayıları on binlerle ifade edilen propagandist vaizleriyle, Kuran-ı Kerim yakmak ve Hz. Muhammed’e terörist demek gibi eylemleriyle, Yahudileri İsrail’i Filistinlilerden temizlemeye teşvik etmeleriyle, bu uğurda onlara ciddi bir finansal ve manevi destek sağlamalarıyla ve Batı devletlerini İsrail’in düşman olarak algıladığı Müslüman komşularıyla savaşmaya teşvik eden lobicilik faaliyetleriyle Hıristiyan siyonistler halihazırda İslam’ın yüzleştiği en ciddi meydan okumalardan birisini teşkil etmektedir. Bu hareketin zararlı sonuçlarıyla mücadele etmek için atılması gereken en önemli adım araştırmaları derinleştirerek kitleleri doğru şekilde bilgilendirmek olacaktır. (shrink)

Mezheplerin teşekkül etmeye başladığı ilk dönemlerden itibaren istihsanın bir istidlal yöntemi olup olmadığı tartışılagelmiştir. Bu tartışmaların temelinde kavramsallaşma sürecini henüz tamamlamamış olan istihsan teriminin çağrıştırdığı keyfiliğin/sübjektivitenin etkisi çok fazladır. Bu yüzden istihsanı bir yöntem olarak benimseyenler, ağır ithamlara maruz kalmışlardır. İstihsanı benimseyenlerin başında Hanefî hukukçular gelmektedir. Öyle ki istihsan yöntemi Hanefî mezhebiyle anılır hale gelmiştir. Bununla birlikte mezhebin önde gelen temsilcilerinden biri olan ve kıyas metodunu kullanmasıyla ön plana çıkan Züfer b. Hüzeyl’in istihsana yaklaşımıyla ilgili iki farklı yaklaşım tespitedilmiştir. Yaptığımız (...) araştırma ve inceleme neticesinde her iki tespitinde isabetli olmadığını; Züfer b. Hüzeyl’inkıyas yapmadaki becerisinin yanı sıra istihsana müracaatta sonuna kadar kıyas taraftarı olduğunu; ancak kıyasın meselelere çözüm üretmede yetersiz kaldığı ya da doğru sonuç vermediği durumlarda ise ızdırârın da bir gereği olarak meseleyi hükümsüz bırakmama adına istihsana müracaat ettiği görülmektedir. Sonuç olarak Züfer b. Hüzeyl’in genel hatlarıyla Hanefî usulüne bağlı kalmakla birlikte istihsanı bir istidlâl yöntemi olarak kullanma hususunda çerçeveyi oldukça daralttığını; kıyasa başvurma konusunda ise sınırları mümkün olduğunca geniş tuttuğunu söylemek mümkündür. İctihad hürriyeti ve hukûkî zenginlik açısından oldukça önemli olan Hanefi mezhebindeki mezhep içi ihtilaflar, hukûkî istikrar ve emniyeti tehdit etme potansiyeli taşımakta ve ayrıca ihtilaflı meselelerde hüküm veya fetva verecek fakihlerin işini zorlaştırmaktadır. Bu nedenle mezhep içerisindeki ihtilaflı meselelerde râcih görüşü tespit etmek, diğer bir ifadeyle mezhep içi tercih, zorunlu bir ihtiyaçtır. Mezhep içi tercih, “muayyen bir mesele ile ilgili mezhepteki muhtelif kavil veya rivayetlerden daha ağır basanı, üstün olanı belirlemek” şeklinde tarif edilebilir. Tarihi süreçte bu ihtiyacı karşılamak için muhtasar ve fetva kitapları gibi farklı telif türleri; esahh-ı akvâl ve maʻrûzât gibi farklı uygulamalar ortaya çıkmıştır. Bu ihtiyacı gidermeyi hedefleyen uygulamalardan biri de Osmanlı Devleti’nin son dönemindeki kanunlaştırmalardır. Fıkha dayalı kanunlaştırmanın ilk örneği olan Mecelle-i Ahkâm-ı Adliyye ile mezhep içi tercih arasındaki ilişki ve bu bağlamda Mecelle hazırlanırken, mezhep içi tercihte nasıl bir usûl izlendiği; râcih görüşe ne oranda uyulduğu; Mecelleʼde yer alan râcih görüşe aykırı kanun maddeleri ve bunların gerekçeleri; ihtilaflı bütün konularda düzenleneme yapılıp yapılmadığı ve râcih görüşleri belirleme ihtiyacının ne kadar giderildiği, incelenmesi gereken konulardır. Mecelle-i Ahkâm-ı Adliyye gibi bir kanun metnine ihtiyaç duyulmasının temel nedenlerinden birisi, Hanefî mezhebinde mezhep içi ihtilafların çokluğudur. Buna bağlı olarak Mecelleʼnin hedefi râcih görüşler içeren oluşan bir kanun hazırlamaktır. Mecelle’nin esbâb-ı mûcibeleri mezhep içi tercih açısından incelendiğinde, esbâb-ı mûcibelerin iki temel işlevi olduğu görülür. Bunlardan ilki, kanunun büyük oranda mezhepteki râcih görüşlere uygun olarak hazırlandığını vurgulamaktır. Öyle ki, Mecelle’nin ilk on kitabının esbâb-ı mûcibelerinde bu husus mutlaka ifade edilmektedir. Esbâb-ı mûcibelerin diğer işlevi ise niçin bazı maddelerde râcih görüşe riayet edilmediğini gerekçelendirmektir. Esbâb-ı mûcibelerde on iki maddenin râcih olmayan görüş doğrultusunda hazırlandığı belirtilmektedir. Mecelleʼnin 1851 maddeden oluştuğu göz önünde tutulduğunda Mecelleʼnin muhtevasında râcih görüşlerin ne kadar etkili olduğu daha iyi anlaşılacaktır. Esasen devrin özelliği de bunu zorunlu kılmaktadır. Zira Kitâbüʼl-Havâlenin 692. maddesinde Züferʼin râcih olmayan görüşünün tercih edilmesi, başta Şeyhülislam Hasan Fehmi Efendi olmak üzere bazı çevrelerin tepkisine neden olmuş ve bu sebeple Ahmet Cevdet Paşa Divân-ı Ahkâm-ı Adliyye nâzırlığından ve Mecelle Komisyonu başkanlığından azledilmiştir. Râcih görüşe aykırı maddelerin esbâb-ı mûcibeleri incelendiğinde, bu yöndeki tercihlerde maslahat ve örfün belirleyici olduğu görülmektedir. Ayrıca bazı fakihlerin tercihlerinin de bir tercih sebebi olarak zikredildiği görülmektedir. Hanefi kaynaklarda en sık karşılaşılan tercih sebebi naslara uygunluktur. Buna karşın Mecelleʼde sefîhin hacri konusu dışında, naslara uygunluğun bir tercih sebebi olarak işletilmemesi dikkat çekicidir. Mecelle Komisyonunun bazı tercihlerine diğer kurumlarca müdahale edilmiştir. Komisyonca hazırlanan kitaplar hem Meclis-i Vükelâ hem de Meşîhat tarafından incelenmiş ve bu esnada bazı tashihlere konu olmuştur. İşte râcih olmayan görüş esas alınarak hazırlanan iki maddeye Meclis-i Vükelâ tarafından müdahale edilmiştir. Bunların birincisi hakk-ı mürur ve hakk-ı şirbin müstakil olarak satımının cevazını savunan Belh Meşâyihinin görüşü doğrultusunda yazılan 216. madde, ikincisi ise ecîr-i müşterekin tazmin sorumluluğunu düzenleyen 611. maddedir. Mecelle’nin ilk ve en hacimli kitabı olan Kitâbüʼl-Büyûʻun muhtevası mezhep içi tercih açısından incelendiğinde, ihtilaflı konularda genelde mezhepteki râcih görüşün esas alındığı görülmektedir. Kitâbüʼl-Büyûʻun esbâb-ı mûcibesinde, dört meselenin râcih olmayan görüş esas alınarak hazırlandığı ifade edilmekte ve bu tercihler örf ve maslahatla gerekçelendirilmektedir. Ancak Kitâbüʼl-Büyûʻdaki râcih görüşe aykırı maddeler bunlarla sınırlı değildir. Bizim araştırmamıza göre bunlara ilaveten üç madde daha râcih olmayan görüş tercih edilerek hazırlanmıştır. Bunlar beyʻ biʼl-vefânın menkullerde cevazına dair 118. madde, gabn-i fâhişin tanımı hakkındaki 165. madde ve şart muhayyerliğinin hükmü ile ilgili 309. maddedir. Bu üç madde, Mecelleʼdeki râcih görüşe aykırı düzenlemelerin sadece esbâb-ı mûcibelerde açıklananlardan ibaret olmadığını göstermektedir ve bu durum Mecelle hazırlanırken izlenen usûle aykırıdır. Hanefi mezhebindeki bazı ihtilaflı meselelerde hangi görüşün râcih olduğu konusunda tercih ehli fakihler ihtilaf etmişlerdir. Bu meselelerde Mecelleʼde düzenleme yapılırken nasıl bir yol izlendiği açıklanmamıştır. Bu meseleler incelendiğinde çoğunluk tarafından tercih edilme, kolaylığı temin etme ve bazı fakihler tarafından tercih edilme gibi hususların etkili olduğu söylenebilir. Mecelleʼdeki tercihler sadece şerʻî hükümler arasında gerçekleşmemiştir. Buna ilaveten tanımlar ve tanımlarda yer alan kayıtlar da tercihe konu olmuştur. Bu kapsamda Kitâbüʼl-Büyûʻdaki beyʻ akdi, mevkûf akid ve gabn-i fâhişin tanımına ilişkin tercihler örnek olarak zikredilebilir. Hanefi mezhebin içerisindeki ihtilaflı bazı meseleler Mecelleʼde düzenlenmemiştir. İhtilaflı meselelerin çokluğu ve dolayısıyla bütün bunları kapsayan bir kanun hazırlamanın zorluğu dikkate alındığında bu durum doğaldır. Ayrıca bu meselelerden bazıları sık gerçekleşmediği ve lüzumlu görülmediği için Mecelleʼde düzenlenmemiş olabilir. Ancak düzenleme yapılmayan ihtilaflı meselelerin tamamını bu sebeplerle izah etmek mümkün değildir. Zira yasal düzenleme yapılmayan ihtilaflı meselelerin bazıları temel, görece önemli meselelerdir ve muhtasarlarda yer almaktadır. Bu durum Mecelle hazırlanırken, ihtilaflı bazı meselelerde tercih yapmak yerine bu meselelere ilişkin düzenleme yapmama metodunun benimsendiğini göstermektedir. İhtilaftan ârî bir kanun metni oluşturmanın bir yolu olarak da bu usûlün benimsendiği söylenebilir. Böylece bu meselelerde râcih görüşü tespit etme işi hâkimlere bırakılmıştır. Bu durum Mecelleʼnin hedefi olan râcih görüşleri tespit etme ihtiyacını gidermeye uygunluk arz etmemektedir. Ancak bu durum bütün meseleleri kuşatan bir kanun yapmanın güçlüğünün bir sonucudur. Siyaset alanı, ortak bir epistemik topluluk ve bu topluluk dolayımında öğrendiklerimiz üzerine kuruludur. Kendimize bu dünyada bir yaşam alanı kurarken öğrendiklerimizin doğru olduğuna dair epistemik güvenden hareket ederiz. Epistemik güven, yalan ve manipülasyonun her icrasında sarsılır. Böyle bir ortamda bir yanda üretilen yalana, kayıtsızlık ve ilgisizlikleri nedeniyle inanan kapalı ve dogmatik kitlelerin sayısı artarken, öte yanda siyasal inançlara yönelik şüphecilik ve agnostisizmden beslenen anlaşmazlıklar yaygınlaşır. Bu çalışma, epistemolojinin kavramsal araçlarından biri olan epistemik sorumluluğu ele almakta ve siyasal alanda ortaya çıkan (...) anlaşmazlıkların nedenlerini çözümlemede işlevsel olabileceğini değerlendirmektedir. Tartışmanın ilk aşaması, içselciler ile dışsalcıların epistemik sorumluluk konusunda ayrıldığı hususlara, ikinci aşaması ise siyasal alanda epistemik sorumluluğu tanımlama denemesine ayrılmıştır. Geçmişte yazılan ve kütüphanelerimizde çoğu yazma hâlinde duran pek çok ilmî eserin isim, müellif ve mütercimlerinin tespiti konusunda ciddî hatalar yapıldığı görülmektedir. Bu da bir kısım önemli eserlerin gün yüzüne çıkmasını engelleyerek sahip olduğumuz hazineden gereği gibi istifade etme imkânını elimizden almaktadır. Bu minvalde bazı araştırma ve kütüphane kayıtlarında 15. yüzyıl Osmanlı âlimlerinden Mûsâ İznikī’nin (öl. 838/1434-35 [?]), Ali b. Muhammed el-Hâzin’in (öl. 741/1341) Lübâbü’t-teʾvîl fî meʿâni’t-Tenzîl adlı tefsirini tercüme ettiği bilgisi yer almıştır. Aynı şekilde yine 16. Yüzyılda yaşamış bir (...) Osmanlı âlimi ve divan şâiri olan Muslihuddin Mustafa Sürûrî’nin (öl. 969/1562) tam bir Türkçe tefsir yazdığı iddia edilmektedir. Bu iki iddia, sonuçta aynı mütercim üzerinde birleşmeleri sebebiyle ortak bir noktaya sahiptirler. Bu makalede, bahsedilen iki eserin asılları ve tercümeleri etrafında bir araştırma yapılarak bunların gerçekte kime ait oldukları ve isimlerinin ne olduğu ortaya çıkarılmaya çalışılacaktır. Bu tür araştırmaların kütüphanelerimizdeki binlerce eser için âcilen yapılmasının bir zaruret hâlini aldığı âşikârdır. Zira bazı araştırmacıların bu tür yanlış bilgiler üzerine yüksek lisans ve doktora tezleri binâ ettikleri ve çeşitli makaleler yazdıkları görülmektedir. Bu makalenin maksadı, yukarıda zikredilen ve haklarında yanlış bilgiler ile bazı kapalı noktalar bulunan iki eserle ilgili bir takım yeni tespitleri ortaya koyarak hem ilim dünyasına katkıda bulunmak hem de bu alanda yapılacak çalışmalara olan ihtiyaca dikkat çekmektir. Doküman tarama, veri toplama ve veri analizi yöntemi kullanılan bu araştırma neticesinde şu sonuçlara varılmıştır: Mûsâ el-İznikī’nin tercüme ederek Tefsîru’l-Lübâb ismini verdiği eser aslında Hâzin’in Lübâbü’t-te’vîl’i değil Necmeddîn-i Dâye’nin (öl. 654/1256) Baḥrü’l-ḥaḳāʾiḳ ve’l-meʿânî isimli tefsirinin muhtasarıdır. Bundan hareketle tespit edilen diğer bir nokta da şu olmuştur ki günümüzde et-Teʾvîlâtü’n-Necmiyye ismiyle meşhur olan eser Dâye’nin kaleme aldığı tefsirin orijinal hâli değildir. Dâye zâhiri ve işârî tefsîri cem eden mufassal bir tefsir telif etmiş, müridlerinden biri olan Şemseddin Muhammed es-Savcı da, zâhirî tefsir kısımlarını çıkarıp sadece işârî yorumları bırakmak sûretiyle bu eseri telhis etmiştir. İznikī de işte bu telhisi tercüme etmiş ve eserine Tefsîru’l-Lübâb ismini vermiştir. Sürûrî’ye nispet edilen tefsirin de onun tarafından telif edilmediği tespit edilmiştir. Yapılan mukayeseler neticesinde bu eserin Ebü’l-Leys Semerkandî’nin (öl. 373/983) Tefsîrü’l-Ḳurʾâni’l-Kerîm veya Tefsîru Ebi’l-Leys̱ es-Semerḳandî diye anılan ve bugün Baḥrü’l-ʿulûm ismiyle basılan kitabının tefsîrî bir tercümesi olduğu ortaya çıkmıştır. Bu tercüme bazı kaynaklar ile kütüphane kayıtlarında aynı anda hem Ahmed-i Dâî’ye (öl. 824/1421’den sonra), hem İbn Arabşah’a (öl. 854/1450) ve hem de İznikī’ye nispet edilmektedir. Farklı kişilere nispet edilen nüshalar karşılaştırıldığında hepsinin aynı eser olduğu görülmüştür. Bazı kadîm nüshalarda görülen ferağ kayıtları ile yazma nüshalar üzerinde yapılan incelemeler bu tercümenin de yine İznikī tarafından yapıldığını göstermektedir. İznikī bu ikinci tercümesine Enfesü’l-Cevâhir ismini vermiştir. İlim dünyasında bu isim konusunda da bir karışıklık olmuş, bazı araştırmacılar onun Hâzin tefsirinin tercümesine verildiğini zannetmişlerdir. Ancak ilk devir yazmalarında bu ismin Semerkandî tefsirinin tercümesine verildiği açıkça görülmektedir. Kütüphanelerimizde Enfesü’l-Cevâhir’in muhtasar nüshalarına da rastlanmış ancak bu ihtisar faaliyetinin kimin tarafından yapıldığı tespit edilememiştir. (shrink)

The review of the collective monograph "Running and Philosophy", which has not been introduced into the sphere of domestic research of philosophical aspects of physical culture and sports, is presented. Marathon for the Mind" (published in English in 2007). The publication includes 19 essays prepared by American philosophers. The professional study of the socio-cultural determination and the existential significance of running practices by the authors of the monograph is effectively combined with the analysis of personal experience of participating in stayer (...) races, which provides a confessional and emotional presentation, as well as practical confirmation of the results obtained. It can be assumed that the content of the collection under consideration covers the main thematic repertoire and represents the research techniques of the philosophy of running that has been forming since the second half of the twentieth century. The reviewed monograph reveals the humanistic potential of running as a factor of anthropogenesis (Sh. Kay), a means of achieving "correct" apathy (R. Devitt) and the highest kind of friendship (M. V. Austin). R. A. Belliotti considers running as a way to gain superhuman standing, H. L. Reed and R. S. Reed find in it the embodiment of the values of existentialism. Within the framework of solving the problems of anthropological dualism, running activity is addressed by J. J. Wisniewski, M. Maze, C. Taliaferro and R. Trauber. K. Martin and M. S. Nussbaum consider running as a medium of aesthetic experience generation, R. J. van Arragon and K. Kinghorn reflect on the typology of runners. D. P. Fry and J. P. Moreland The connection between running and religious practices is investigated, G. Basham, K. Kelly, U. P. Kabasench and D. R. Hochstetler analyze the correlation of goals and means of running activity. Thus, the monograph substantiates the understanding of running as a publicly available and effective means of gaining physical, mental and social well-being, which expresses the humanistic essence of running practices and justifies the philosophical and anthropological significance of their research. In everyday life, we assume that there are degrees of blameworthiness and praiseworthiness. Yet the debate about the nature of moral responsibility often focuses on the “yes or no” question of whether indeterminism is required for moral responsibility, while questions about what accounts for more or less blameworthiness or praiseworthiness are underexplored. In this paper, I defend the idea that degrees of blameworthiness and praiseworthiness can depend in part on degrees of difficulty and degrees of sacrifice required for performing the (...) action in question. Then I turn to the question of how existing accounts of the nature of moral responsibility might be seen to accommodate these facts. In each case of prominent compatibilist and incompatibilist accounts that I consider, I argue that supplementation with added dimensions is required in order to account for facts about degrees of blameworthiness and praiseworthiness. For example, I argue that the reasons-responsiveness view of Fischer and Ravizza requires supplementation that takes us beyond even fine-grained measures of degrees of reasons-responsiveness in order to capture facts about degrees of difficulty to extend the reasons-responsiveness view by appealing to such measures). I conclude by showing that once we recognize the need for these additional parameters, we will be in a position to explain away at least some of the appeal of incompatibilist accounts of moral responsibility.
